Advice: introduce a standard implementation test for the Caribbean Netherlands

THE HAGUE – New laws and policy measures should henceforth be assessed as standard for their consequences for Bonaire, Sint Eustatius and Saba. This is the advice given by DSP-groep to the Ministry of the Interior.

According to the report, the Caribbean islands are still too often involved only at a late stage in new legislation. As a result, regulations frequently fail to align with the limited implementation capacity and local circumstances on the islands.

DSP-groep proposes that an upfront assessment be made of whether an implementation test is required. Depending on the impact, a choice can be made between a quick test, an in-depth analysis or a full implementation plan. The advisory firm also recommends that the islands are automatically included whenever an implementation test is already being carried out for Dutch municipalities.

In addition, DSP-groep advocates that ministries provide better justification for why new Dutch legislation can or cannot apply unchanged to the Caribbean Netherlands. This should help prevent implementation problems at an earlier stage and give the islands a permanent place in the legislative process.
